Copyright Infringement Notification Guidelines

DMCA NOTICES

It is JenioArt's policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act ("DMCA"). If you are a copyright owner or an agent of one, and you believe that any Content or Music Contributions on the Services infringe your copyrights, you may submit a notification pursuant to the DMCA by providing JenioArt's Designated Copyright Agent, as described below, with the following information in writing:

  • Your physical or electronic signature as the owner or the signature of a person authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit JenioArt to locate the material.
  • Information reasonably sufficient to permit JenioArt to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by you as the copyright owner, or its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

In order to ensure that copyright owners do not wrongly insist on the removal of materials that actually do not infringe their copyrights, JenioArt will notify the subscribers if their materials have been removed and provide them with an opportunity to send JenioArt a counter-notice, as described below.

JenioArt will promptly terminate without notice those accounts of users which JenioArt determines are "repeat infringers." A repeat infringer is a user who has been notified by JenioArt of infringing activity violations more than once.

DMCA COUNTER-NOTICES

If you believe that your Content or Music Contributions should not have been taken down because they are not infringing, then you may send a counter-notice. A proper counter-notice must contain the following information:

  • Your name, address, phone number and physical or electronic signature.
  • Identification of the material and its location before removal.
  • A statement under penalty of perjury that the material was removed by mistake or misidentification.
  • Your consent to local federal court jurisdiction, or if overseas, to an appropriate judicial body.

In the event JenioArt receives a proper counter-notice, JenioArt will give notice to the original complainant, and if the original complainant does not file a proper response within the statutory time period, then JenioArt will restore the material that was taken down.
