This notice describes JenioArt's privacy policy (hereinafter referred to as "Privacy Policy") and applies to JenioArt's Service. This Privacy Policy applies to you, as a user of JenioArt Service and as an end user of the User Contributions provided by users of the JenioArt Website and Mobile Applications ("Service").


Your use of the Service is also subject to the Terms of Service. Please review the Terms of Service, located at for additional details regarding your use of the Service. All capitalized terms have the same meaning as defined in the Terms of Use unless otherwise stated herein.


JenioArt may require users who wish to use the Service to register by completing the appropriate JenioArt registration process. During registration, you will be required to provide valid contact information including your name, e-mail address, and username and password. We ask for birth dates to validate your age. For users who do not register an account with JenioArt, portions of the Service may not be available, such as creation of quizzes and the tracking of scores and rewards.

Only persons 13 years of age or older are able to register a JenioArt account. If you are age 13 through 17, you may use the Service if a parent or legal guardian agrees to be bound by these Terms of Use. If you are a parent or guardian agreeing to these Terms of Use for the benefit of a minor age 13 though 17, be advised that you are fully responsible for his or her use of the Service and any and all legal liability that he or she may incur. A parent or guardian and/or a person who has express authority from a parent or guardian ("Supervisor") may allow a child under the age of 13 to create a sub-account ("Sub-account") within the Supervisor's master account ("Master Account"). The Sub-account may only be accessed under the Supervisor's supervision from within the Master Account when the Master Account is accessed by the Supervisor. The parent or guardian agrees to be responsible for all acts of minors and children.

Protection of Children

JenioArt recognizes the need to provide further privacy protections with respect to children under the age of 13 ("child" or "children"). Parents or legal guardians of children must consent to this Privacy Policy before a child may use the Service. The JenioArt Service is age-gated so that children cannot create a JenioArt account unless a Supervisor creates a Master Account and allows use by the child in a Sub-Account. JenioArt does not knowingly collect personal information, such as an email address, from children in connection to our Service.

Children may only create a JenioArt account under the supervision of a Supervisor. Children cannot access the JenioArt Service without access to a valid account created by a Supervisor. Once a Supervisor creates a JenioArt account, the Supervisor may allow the child to use the JenioArt Service under the Supervisor's account. In such a case, JenioArt does not collect personal information from the child. JenioArt only collects a nickname created by the child and a system generated image that the child selects for a password. The child nickname and system generated password are not used by JenioArt for contacting the child, and such information is only used to match quiz activity and scores to the user. In the event JenioArt collects personal information from children, we will take additional steps to protect children's privacy, in accordance with the Children's Online Privacy Policy ("COPPA"), in receiving proper consent from parents or legal guardians to collect such personal information. In the event we discover we have collected additional information from a child in a manner inconsistent with COPPA's requirement we will delete the information. We strongly advise Supervisors to monitor a child's activity and advise against providing any personal information in the child's nickname. Personally Identifiable Information (PII)

PII is information that identifies you or can be used to identify, contact, or locate you. This includes, but is not limited to, your name, home or business address, email address, telephone number, and debit or credit card information such as the credit card number or billing address. JenioArt respects your privacy. We only collect PII through optional, voluntary submissions, such as during registration to create a JenioArt account. The types and amount of personal information collected from these activities will vary, but in no event will we collect PII that is not voluntarily given by you when using JenioArt 's Service and we do not collect PII from children. You consent to JenioArt using your PII to facilitate requests, to contact you if a problem arises, email you information about our services, or for other uses consistent with this Policy and your requests. JenioArt does not collect any personal information from non-registered users or Children, as is more fully explained above under Protection of Children.

Non-Personally Identifiable Information (Non-PII)

JenioArt collects statistical use data about your use of the Service. This data neither identifies you personally and is purely statistical data, such as the date an end user uses a User Submission, approximate geo-location of the end user and length of use and other similar anonymous data. Such anonymous statistics help maintain the quality and efficiency of the Service. Such analysis and information is aggregated across viewers, does not identify anyone as an individual and does not link to any personally identifiable information.

Sharing with Third Parties

JenioArt does not share your PII with third parties without your consent except as explained in this Policy. JenioArt may share PII only to trusted business partners who provide services to JenioArt and who are bound to confidentiality. JenioArt may share non-PII in the aggregate regarding viewing and quiz information with the taker of a quiz or creator of the quiz. Also, any person to visit the JenioArt Service, whether or not a registered user, can see how many times a quiz (excluding Private Quizzes) has been taken and anonymous average scores.

Should JenioArt merge with or be acquired by another company, or if the business unit providing your service were sold to another company, any information collected may be transferred to and used by the resulting combined company. If JenioArt were to cease operations, this data might be transferred to and used by another company, which offers similar or related products or services.

Third Party Links

We may display links, and users may post links to a third party service or website. Please note that we cannot control and cannot be held responsible for the privacy policies of such third party service. You should always read the privacy policy of a third party service to find out more about how personal information is collected and processed.

Use of IP Addresses

As with any Internet-based service, queries to our service transmit an Internet Protocol (IP) address, as this is what allows delivery of the information you requested back to you. We also use IP addresses for security purposes and to determine the approximate geographic location (the country or metropolitan region) of the query. We use the approximate geographic location to create aggregate statistics, such as use or non-use of the Content by country or region, which we may share with the owner of the Content. We do not use IP addresses to identify an individual user by name, address or exact location. It is possible that we might be legally required to make a disclosure, for example, in response to court orders or in governmental investigations.

Cookies, Log Information and Opt Out

When you are logged into your account, JenioArt sends one or more cookies (which is a small file containing a string of characters) to your computer or other device to maintain the session when you are logged into the JenioArt Service and provide the best experience using the Service. JenioArt servers automatically record information that your browser sends whenever you log into your user account. These server logs may include information such as your web request, IP address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser. You may refuse the use of cookies by selecting the appropriate settings on your browser, however, please note that if you do this you will not be able to use the full functionality of the Service.

User Communications and Opt-Out

When you send email or other communications to JenioArt, JenioArt may retain those communications and related e-mail addresses in order to process your inquiries, respond to your requests and improve our services. In addition, JenioArt may use your username and email address to provide you with email newsletters, announcements, JenioArt news about products and/or services, information about your user account, and changes to this Privacy Policy. If you do not wish to receive these kinds of communications, you may "opt out" by unsubscribing to email communications by following the directions in the email.

Legal Compliance

JenioArt may disclose any information we collect, including both PII and Non-PII, if required to do so by law or under a good faith belief that such action is necessary to conform to the law or comply with legal process or to protect and defend JenioArt 's rights, property, and end users, whether or not required to do so by law. JenioArt reserves the right to contact appropriate authorities and disclose such information to them at its discretion when it appears that individuals using JenioArt 's products or services are engaged in activities that are illegal or violate the JenioArt Terms of Use.

Secured Information

JenioArt maintains a variety of physical, electronic and procedural safeguards to guard your information and to deliver the services and features of the Service. While JenioArt cannot guarantee that loss, misuse or alteration of your data will not occur, JenioArt works hard to prevent such occurrences.

Governing Law

This Privacy Policy is governed by the laws of the California without respect to conflict of law principles. You agree and submit to the exclusive jurisdiction of the courts in San Francisco, California for resolution of any dispute, action or proceeding arising in connection with this Agreement.

Deletion of and Access to your Personal Information

In the event you desire to be informed of or access all of the personally identifiable information we hold about you, and you may do so by visiting your user account when logged-in to the Service, or by e-mailing us at the address set forth below. You also have the right to delete such personal information and your account at anytime. Please note, however, that once you delete such information, it may not be recoverable and you may not be able to fully utilize the Service.

Privacy Policy Updates

JenioArt will update this Privacy Policy as JenioArt 's business and services expand and change. Updates to this policy will be posted on the Service and will be emailed to the user. Your continued use of the Service will constitute consent to the new terms. JenioArt encourages you to review this policy periodically for any changes that may have been posted.

California Residents

California Civil Code Section § 1798.83 permits users of the Service that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. JenioArt currently does not disclose information to third parties for their direct marketing purposes.
